Terms and Conditions of Location-based Services

Article 1 Purpose

The purpose of these Terms of Service is to define the rights, obligations, and responsibilities between Acote Consulting Co., Ltd. (hereinafter referred to as the "Company") and the individual location information subject (hereinafter referred to as the "User") who uses the location-based services provided by the Company, and to stipulate other necessary matters.

Article 2 Effective Date and Amendment of Terms of Service

1. These Terms of Service shall become effective upon the User's agreement to these Terms and registration as a user of the Location-Based Services in accordance with the procedures specified by the Company.
2. By clicking the "Agree" button, the User acknowledges that they have read and fully understood these Terms of Service and agree to be bound by them.
3. The Company may amend these Terms of Service to the extent that such amendment does not violate the Act on the Protection and Utilization of Location Information (hereinafter referred to as the "Location Information Act"), the Content Industry Promotion Act, the Act on the Protection of Consumers in Electronic Commerce Transactions, the Consumer Basic Act, the Act on the Regulation of Standard Terms of Contract, and other relevant laws and regulations.
4. If the Terms of Service are amended, the Company shall provide notice of such amendments at least 7 days prior to the effective date of the amended terms through the Company's homepage or mobile web notice. However, if the amended terms result in a significant change to the User's rights, the Company shall provide notice at least 30 days prior to the effective date by posting such notice on the mobile web or sending a notification to the User by electronic means (e-mail, SMS, electronic message within the service, etc.).
5. If the Company has clearly notified the User that the User's silence will be deemed as consent to the amended terms, and the User has not expressed their disagreement within 7 days from the date of the notice, the User shall be deemed to have consented to the amended terms. If the User does not agree to the amended terms, they may withdraw their consent to these Terms of Service.

Article 3 Governing Rules and Regulations

For any matters not explicitly stated in these Terms of Service, the relevant laws and regulations, including the Act on the Protection and Utilization of Location Information, the Personal Information Protection Act, the Telecommunications Business Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, as well as the Company's internal policies, shall apply.

Article 4 Scope of Services

The Company provides the following location-based services using the User's location information collected from location information providers:
1. Information search results and content provision or recommendation services utilizing location information
2. Content tagging for location-based content classification
3. Location-based customized advertising

   1) The purposes and retention period for the location-based services provided by the company and the personal location information are as follows:

Article 5 Notice of Changes to Service

1. If the Company changes or terminates the Service, the Company may notify the User of such changes or termination via email sent to the registered email address (or by other electronic means such as sending an electronic message within the Service or displaying a notification message within the Service, if the User has not registered an email address).
2. In the case of a notice to an unspecified number of users, the Company may provide notice by posting such notice on the website, mobile application, or mobile web bulletin board.

Article 6 Service Fees

The location-based services provided by the Company are free of charge. However, data usage charges for wireless services may apply separately, and such charges shall be subject to the policies of the respective mobile carriers that the User subscribes to.

Article 7Modification, Restriction, or Termination of Service

1. The Company may modify, restrict, or terminate, in whole or in part, the location-based services due to changes in policies, relevant laws, or other circumstances that make it impossible for the Company to continue providing such services.
2. The Company may restrict or terminate a User's use of the Service in the following cases:
   1) When a User intentionally or negligently interferes with the operation of the Company's services
   2) When it is unavoidable due to inspection, repair, or construction of service facilities
   3) When a telecommunications business operator, as defined in the Telecommunications Business Act, has suspended telecommunications services
   4) When there is a national emergency, a failure of service facilities, or a surge in service usage that hinders the use of the service 5) In other cases where the Company deems it inappropriate to continue providing the service due to a significant reason
3. If the Company restricts or terminates the use of the service pursuant to paragraphs 1 and 2, the Company shall provide prior notice of the reason and duration of such restriction or termination through the Company's website or by notifying the User.

Article 8Use and Provision of Personal Location Information

1. The Company shall obtain the prior consent of the User, as specified in the Terms of Service, before using the User's personal location information to provide the Service.
2. Except with the consent of the User or in any of the following cases, the Company shall not use or provide the User's personal location information or records of the use or provision of location information beyond the scope specified or notified in the Terms of Service:
    1) When records of the use or provision of location information are necessary for billing related to the provision of location-based services.
    2) When providing anonymized data for statistical analysis, academic research, or market research.
3. If the Company provides the User's personal location information to a third party designated by the User, the Company shall immediately notify the User, via the communication terminal through which the personal location information was collected, of the recipient, the date and time of provision, and the purpose of provision. However, in the following cases, the Company shall notify the User through a specified communication terminal, email address, or online posting designated by the User in advance:
    1) If the communication terminal through which the personal location information was collected does not have a function for receiving text messages, voice, or video.
   2) If the User has requested in advance that the notice be sent to a communication terminal other than the communication terminal through which the User's personal location information was collected, or via email address or online posting.
4. Pursuant to Article 16(2) of the Act on the Protection and Utilization of Location Information, the Company shall automatically record and retain records of the use or provision of personal location information and shall retain such records for six months.

Article 9Purpose and Retention Period of Personal Location Information

The Company retains personal location information for the following purposes in providing location-based services:
1. Pursuant to Article 16(2) of the Act on the Protection and Utilization of Location Information, the Company shall automatically record and retain records of the use or provision of location information for a period of six months.
2. The Company shall promptly delete personal location information, except for records of the use or provision of location information, upon achieving the purpose of using or providing such information.
3. In the case of services where location information is stored together with user-generated content, personal location information shall be retained for the duration of the retention period of the relevant content.
4. For other purposes necessary for providing location-based services, the Company may retain personal location information for the minimum period necessary to achieve the purpose of use.
5. Notwithstanding the provisions of paragraphs 2, 3, and 4 above, the Company shall comply with any other laws or regulations that require the retention of personal location information.

Article 10 Provision of Personal Location Information to Third Parties

1. If the Company provides a User's personal location information to a third party designated by the User, the Company shall obtain the User's prior consent after notifying the User of the recipient and the purpose of the provision.
2. In cases where personal location information is provided to a third party designated by the User pursuant to paragraph 2, the Company shall immediately notify the User, via the communication terminal through which the personal location information was collected or by email, of the recipient, the date and time of provision, and the purpose of provision.
3. Except with the consent of the User or in any of the following cases, the Company shall not use or provide the User's personal location information or records of the use or provision of location information beyond the scope specified or notified in the Terms of Service:
   - Billing: When records of the use or provision of location information are necessary for billing related to the provision of location-based services.
   - Anonymized Data: When providing anonymized data for statistical analysis, academic research, or market research.

Article 11 Rights of the Individual Whose Personal Location Information Is Processed

1. A User may at any time reserve all or part of their consent to the use and provision of location-based services using their personal location information.
2. A User may at any time withdraw all or part of their consent to the use and provision of location-based services using their personal location information. In such a case, the Company shall promptly delete the relevant personal location information and records of the use or provision of location information.
3. A User may request a temporary suspension of the use or provision of their personal location information. In such a case, the Company shall not refuse the request and shall have the technical means to comply with it. 4. A User may request access to or disclosure of the following information, and if there are any errors in such information, may request correction. The Company shall not unreasonably refuse such a request:
   1) Records of the use or provision of location information concerning the User.
   2) The reasons and content of the provision of the User's personal location information to a third party pursuant to the Act on the Protection and Utilization of Location Information or other laws. 5. A User may exercise their rights by contacting the Company using the contact information specified in Articles 1 and 16 of these Terms.

Article 12 Rights of Legal Representatives

1. For Users under the age of 14, the Company shall obtain the consent of both the User and their legal representative for the provision of location-based services using personal location information and for the provision of such information to third parties. In such cases, the legal representative shall have all the rights of the User as stipulated in Article 11 of these Terms.
2. Except as provided in the following subparagraphs, the Company shall obtain the consent of both the User and their legal representative before using or providing a child under the age of 14's personal location information or records of the use or provision of location information beyond the scope specified or notified in the Terms of Service:
   1) When records of the use or provision of location information are necessary for billing related to the provision of location-based services.
   2) When providing anonymized data for statistical analysis, academic research, or market research.

Article 13 Rights of Guardians of Children Under the Age of 8

1. The Company shall deem that consent has been obtained from an individual who falls under the following categories (hereinafter referred to as a "child under 8") if the guardian of such individual, who falls under Article 26(2) of the Act on the Protection and Utilization of Location Information (hereinafter referred to as a "guardian"), consents to the use or provision of the individual's personal location information for the protection of the life or body of such child..
    1) Children under the age of 8
    2) Person under guardianship
    3) Individuals with severe mental disabilities as defined in Article 2, Paragraph 2, Subparagraph 2 of the Act on Welfare of Persons with Disabilities, who are also classified as persons with severe disabilities under Article 2, Paragraph 2 of the Act on Promotion of Employment and Rehabilitation of Persons with Disabilities (limited to those registered as persons with disabilities pursuant to Article 32 of the Act on Welfare of Persons with Disabilities)
2. A guardian who wishes to consent to the use or provision of personal location information for the protection of the life or body of a child under the age of 8 shall submit a written consent form to the Company, together with a document proving their status as a guardian.
3. A guardian who consents to the use or provision of personal location information of a child under the age of 8 may exercise all the rights of a User as stipulated in Article 11 of these Terms.

Article 14 Indemnity

In the event that a User incurs any damages due to the Company's breach of Articles 15 and 26 of the Act on the Protection and Utilization of Location Information, the Company shall be liable to indemnify the User for such damages. The Company shall not be relieved of such liability unless it can prove that it has not acted intentionally or negligently.

Article 15 Disclaimer

1. The Company shall not be liable for any damages arising out of the Company's inability to provide location-based services due to any of the following circumstances:
   1) In the event of a natural disaster or other force majeure event.
   2) In the event of intentional interference with the Location-Based Services by a third party with whom the Company has entered into a service partnership agreement for the provision of Location-Based Services.
   3) If the inability to use the Location-Based Services is due to the User's fault
   4) Except for cases 1,3, in the event of any other circumstances beyond the Company's control or due to causes not attributable to the Company's negligence or willful misconduct.
2. The Company does not warrant the accuracy, completeness, or timeliness of the location-based services or any content thereof, and shall not be liable for any damages arising from any inaccuracies, errors, or omissions therein.

Article 16 Dispute Resolution and Other Matters

1. The Company shall endeavor to resolve any dispute arising out of or in connection with location information through amicable negotiation with the User.
2. If the dispute cannot be resolved through such negotiation, either party may request that the Korea Communications Commission make a ruling pursuant to Article 28 of the Act on the Protection and Utilization of Location Information or request mediation from the Personal Information Dispute Mediation Committee pursuant to Article 43 of the Personal Information Protection Act.

Article 18 Designation of Location Information Manager

1. The Company shall designate a location information manager who holds a position of substantial responsibility for the proper management and protection of location information and for the effective handling of complaints from individuals whose personal location information has been processed.

[Supplementary Provisions]
1. This Agreement shall become effective on [Date], 2024
To the extent that there is any inconsistency between the Korean and English versions of this Agreement, the Korean version shall control.
